Respected Sir,

I am in a terrible situation. It is already 17 years now. Nowhere in this world, is a human being tortured like me in last 5000 years of world history. This is a grave crime against humanity. Also gang stalking itself is a heinous crime. I can’t tolerate it anymore. I want freedom. I want freedom of my family members those who are captive along with me. I want my dues of Rs.71,00,000Crores (US$1trillion). I’ll not accept anything less than Rs.71,00,000Crores (US$1trillion). I also want three written assurances from the President of India. Now I am in financial crisis. So, I want Rs.71,00,000 Crores (US$1trillion) & 3written assurances at the earliest. I don’t want a job and I don’t want to be a politician. I want freedom & Rs.71,00,000Crores (US$1trillion) along with 3written assurances from the President of India. And I’ll marry a girl or 10 (ten) only after I get Rs.71,00,000Crores (US$1trillion) & 3written assurances from the President of India.

I wrote my first petition to the Prime Minister of India on 24.11.2006. Since then I wrote many petitions to the Prime Minister of India, the President of India and to Mrs.Sonia Gandhi. I also sent 20nos of petitions to Chief Justice of India, 9nos of petitions to Chairman of National Human Rights Commission and 14nos of petitions to International Community till date. I also sent total 69nos of bills till date. I sent copy of my each bill to Prime Minister of India, President of India, Chief Justice of India, Chairman of National Human Rights Commission and to International Community. I also lodged a police complaint at Okhla Police Station in 2014. Again I submitted another police complaint at Narayanpur Police Station, Narayanpur, District: Lakhimpur, Assam (India) on 10.07.2021.

Since 2005, Republic of India has been taking many exceptional benefits out of my huge sufferings. But at the same time failed to set me & my family members free from this illegal, inhuman and barbaric confinement with Rs.71,00,000Crores (US$1trillion) & three written assurances from the President of India inspite of my repeated plea since 2006.

I already sent a copy of my petition to the President of India dated 16.02.2022 to Director General of Police, Assam also. After that I sent a RTI application to PIO of the office of Director General of Police (Assam Police Head Quarters) dated 03.03.2022 through speed post seeking following information:

1. What action Director General of Police, Assam has taken on my above Petition to The President of India dated 16.02.2022?

2. What action Assam Police has taken on the complaint I submitted at Narayanpur Police Station on 10.07.2021?

3. When shall I get my dues of Rs.71,00,000 Crores (Us$1trillion)? (Please note I must get US$1 trillion. I’ll not accept anything less than Rs.71,00,000Crores).

4. When shall I get three written assurances from President of India?

5. When I and my family members (those who are captive along with me –as mentioned in my petition to the President of India dated 16.02.2022) will get freedom from this illegal, inhuman and barbaric confinement?

I already sent my 2^nd Appeal to Honorable State Chief Information Commissioner dated 18.10.2022.On 27.12.2022, I received a letter from Assam Information Commission (Letter No.SIC/LPR.15/2022/48 dated 15.12.2022). Accordingly I re submit my this 2^nd Appeal to Honorable State Chief Information Commissioner against office of DGP, Assam (Assam Police Headquarters).

I am enclosing herewith a copy of my RTI application to the PIO of Office of DGP, Assam (Assam Police Headquarters) dated 03.03.2022 and a copy of my First Appeal to The First Appellate Authority of Office of DGP, Assam (Assam Police Head Quarters) dated 12.04.2022. Speed Post Consignment Number in case of my above RTI Application is ES698459055IN and Speed Post consignment number in case of my above First Appeal is ES899188969IN. I am enclosing herewith Xerox copies of my speed post slips against my above RTI application and my above First Appeal as proof of dispatch. I also uploaded JPEG images of my above RTI Application and my above First Appeal along with speed post slips into my blog (www.moinakon.blogspot.com), my facebook (www.facebook.com/tutuborah123) and my twitter (www.twitter.com/tutuborah123).

Reasons for 2^nd Appeal:

Information I sought are of vital public importance, my dues of Rs.71,00,000Crores (US$1trillion) and my freedom from this illegal, inhuman and barbaric confinement along with three written assurances from the President of India. Information I sought are not only crucial to me but also crucial to entire world. Information I sought are of vital public importance which shows the transparency and accountability in the functioning in the office of Director General of Police, Assam and practice of standard operating procedures while such requests are made by public at large.

The PIO of office of DGP, Assam received my above RTI application dated 03.03.2022. But even after completion of mandatory period of 30 days, I have not received any reply from the PIO of office of DGP, Assam (Assam Police Headquarters). So, I sent my First Appeal to The First Appellate Authority of office of DGP, Assam (Assam Police Headquarters) dated 12.04.2022. But to my utter surprise, I have not received any reply/ communication from the first appellate authority of office of DGP, Assam (Assam Police Headquarters) too. This is a clear violation of RTI Act, 2005. No reasonable cause can be there for not replying at all. Both PIO & FAA of office of DGP, Assam not only violated RTI Act, 2005; but also put RTI Act,2005 in great danger. As State Chief Information Commissioner you shouldn’t allow such brazen violation of RTI Act, 2005.

Against Point Number 1 of my RTI petition to The PIO of office of DGP, Assam dated 03.03.2022, Office of DGP, Assam (Assam Police Headquarters) is the best authority in this world to give accurate reply. But the PIO of office of DGP, Assam (Assam Police Headquarters) chose not to give any reply at all. FAA of office of DGP, Assam (Assam Police Headquarters) too ignored my First Appeal. Thus both PIO & FAA of office of DGP, Assam (Assam Police Headquarters) not only violated RTI Act, 2005, but also put RTI Act, 2005 in great danger.

Against Point Number 2 of my RTI petition to The PIO of office of DGP, Assam dated 03.03.2022, Office of DGP, Assam (Assam Police Headquarters) is the best authority to give accurate reply. But the PIO of office of DGP, Assam (Assam Police Headquarters) chose not to give any reply at all. FAA of office of DGP,Assam (Assam Police Headquarters) too ignored my First Appeal. Thus both PIO & FAA of office of DGP, Assam (Assam Police Headquarters) not only violated RTI Act,2005, but also put RTI Act,2005 in great danger.

Against Point Number 3 of my RTI petition to The PIO of office of DGP, Assam dated 03.03.2022 (i.e date of payment of Rs.71,00,000Crores (US$1trillion) to me), Office of DGP, Assam (Assam Police Headquarters) can easily collect that information and should supply that information to me. But the PIO of office of DGP, Assam (Assam Police Headquarters) chose not to give any reply at all. FAA of office of DGP, Assam (Assam Police Headquarters) too ignored my First Appeal. Thus both PIO & FAA of office of DGP, Assam (Assam Police Headquarters) not only violated RTI Act,2005, but also put RTI Act,2005 in great danger.

Against Point Number 4 of my RTI petition to The PIO of office of DGP, Assam dated 03.03.2022, Office of DGP, Assam (Assam Police Headquarters) can easily collect that information from Ministry of Home Affairs, Government of India and should supply that information to me. But the PIO of office of DGP, Assam (Assam Police Headquarters) chose not to give any reply at all. FAA of office of DGP, Assam (Assam Police Headquarters) too ignored my First Appeal. Thus both PIO & FAA of office of DGP, Assam (Assam Police Headquarters) not only violated RTI Act,2005, but also put RTI Act,2005 in great danger.

Against Point Number 5 of my RTI petition to The PIO of office of DGP, Assam dated 03.03.2022, Office of DGP, Assam (Assam Police Headquarters) is one of the best authority to give accurate reply. But the PIO of office of DGP, Assam (Assam Police Headquarters) chose not to give any reply at all. FAA of office of DGP, Assam (Assam Police Headquarters) too ignored my First Appeal. Thus both PIO & FAA of office of DGP, Assam (Assam Police Headquarters) not only violated RTI Act, 2005, but also put RTI Act, 2005 in great danger.

Relief Sought:

Dear Sir, based on my above details & ordeal I have gone through, kindly instruct the PIO & FAA of office of DGP, Assam (Assam Police Head Quarters) to provide me complete (point wise) and accurate information (as sought by me) to me at the earliest & free of cost.

Secondly, also question the FAA why my Appeal was not examined and heard properly. As per RTI Act, 2005; please impose maximum penalty of Rs.25,000/= each on the PIO & FAA which shall be deducted from their salary.

I am ready to come to come to your office for in person inspection of records or in person hearing if I received your notice at least 10days prior to the date of hearing. So, please send your notice for hearing at the earliest through speed post/ email/ whatsapp so that I can receive it 10 days before the date of hearing.

I read the verification format sent to me by Assam Information Commission. One part of that verification format I can sign and verify. But other part I can’t. Because since 2006, I sent many petitions to the Prime Minister of India, The President of India and to Mrs.Sonia Gandhi. I also sent 20nos of petitions to Hon’ble Chief Justice of India, 9nos of Petitions to Hon’ble Chairman of National Human Rights Commission and 14nos of Petitions to UN & International Community. I also sent 69nos of Bills till date. I sent copy of my each bill to Chief Justice of India, Chairman of NHRC, Prime Minister of India and President of India and to UN & International Community. I also sent copy of my each petition to various authorities to Chief Justice of India and Chairman of NHRC. I also sent 3nos of 2^nd Appeal to Hon’ble Chief Information Commissioner. I already attended three hearings of Chief Information Commissioner without any fruitful result. I have no idea what’s going on in Supreme Court of India and in NHRC-in fact it is a matter of serious concern for entire world.

I don’t think any such verification format is required for filing 2^nd appeal under RTI Act,2005. Therefore I’ll not sign and send the verification format sent to me by Assam Information Commission along with my this 2^nd appeal to Honorable State Chief Information Commissioner dated 27.12.2022.

I have waited for replies from the PIO & FAA of office of DGP, Assam (Assam Police Head Quarters) eagerly. If I got any reply/ communication from FAA of office of DGP, Assam (Assam Police Head Quarters) and in case if I was not satisfied with that reply, I would have sent my 2^nd Appeal to Honorable State Chief Information Commissioner within 90 days from the date of receipt of that reply/ communication. Since I am waiting and waiting yet not received any reply from FAA of office of DGP, Assam (Assam Police Head Quarters), I sent my 2^nd Appeal to honorable State Chief Information Commissioner on 18.10.2022. As per instruction of Assam Information Commission, I re submit my this 2^nd Appeal to Honorable State Chief Information Commissioner.

Therefore, I humbly request you to please consider my arguments mentioned above and give your judgments accordingly.
