Sub: Second Appeal under RTI Act, 2005.

Respected Sir,

I am in a terrible situation. It is already 17 years now. Nowhere in this world, a human being is tortured like me in last 5000 years of world history. This is a grave crime against humanity. Also gang stalking itself is a heinous crime. I can’t tolerate it anymore. I want freedom. I want freedom of my family members those who are captive along with me. I want my dues of Rs.71,00,000Crores (US$1trillion). I’ll not accept anything less than Rs.71,00,000Crores (US$1trillion). I also want three written assurances from the President of India.

I wrote my first petition to the Prime Minister of India on 24.11.2006. Since then I wrote many petitions to the Prime Minister of India, the President of India and to Mrs.Sonia Gandhi. I also sent 20nos of petitions to Chief Justice of India, 9nos of petitions to Chairman of National Human Rights Commission and 14nos of petitions to International Community till date. I also sent total 69nos of bills till date. I sent copy of my each bill to Prime Minister of India, President of India, Chief Justice of India, Chairman of National Human Rights Commission and to International Community. I also lodged a police complaint at Okhla Police Station in 2014. Again I submitted another police complaint at Narayanpur Police Station, Narayanpur, District: Lakhimpur, Assam (India) on 10.07.2021.

Since 2005, Republic of India has been taking many exceptional benefits out of my huge sufferings. But at the same time failed to set me and my family members free from this illegal, inhuman and barbaric confinement with Rs.71,00,000Crores (US$1trillion) along with three written assurances from the President of India inspite of my repeated plea since 2006.

I again sent my one another petition to Honorable President of India on 16.02.2022. President’s Secretariat forwarded my petition to the President of India dated 16.02.2022 to the Home Secretary, Government of India vide letter no. Sl No.P1/B/0303220044 DATED 03.03.2022

After that I sent a RTI Application to CPIO of MHA seeking following information (My RTI Application to MHA dated 16.10.2022):

1. What action the Home Secretary of Government of India has taken on my above petition to President of India dated 16.02.2022?

2. When shall I get my dues of Rs.71,00,000 Crores (US$1trillion) ?

3. When shall I get three written assurances from President of India?

4. When Prime Minister will deploy a high power task force to set me and my family members (those who are captive along with me- as mentioned in my petition to President of India dated 16.02.2022 ) free from this illegal, inhuman and barbaric confinement?

5. Recently I noticed my petitions and bills are actionable in President’s Secretariat. But not actionable in PMO & MHA. Why it is so?

Information I sought are of vital public importance, my dues of Rs.71,00,000Crores (US$1trillion) and my freedom from this illegal, inhuman and barbaric confinement along with three written assurances from the President of India. Information I sought are not only crucial to me but also crucial to entire world also. Information I sought are of vital public importance which shows the transparency and accountability in the functioning of MHA and practice of standard operating procedures while such requests are made by public at large.

As I have not received any reply from CPIO of MHA, I sent my First Appeal to the First Appellate Authority of MHA (my first appeal to FAA of MHA dated 18.11.2022).

A few days back I received a reply from FAA of MHA (Letter No. A-43020/27/2022-RTI-A-113 Dated 14.12.2022). He also enclosed a Xerox copy of letter from CPIO of MHA to me (letter No.A-43020/01/2022-RTI-3175 dated 10.11.2022). Earlier I have not received that letter from CPIO of MHA. In his reply CPIO of MHA informed me that information I sought vide my RTI application to MHA dated 16.10.2022 is not covered under the definition of Information as per RTI Act.2005. But those are come under definition of information as per CPIO of President’s secretariat. That’s why CPIO of President’s secretariat in his reply to me (letter No.0014/RTI/04/22-23 dated 06.05.2022) asked me to obtain those information from MHA. That means both CPIO & FAA of MHA not only violated RTI Act, 2005, but also put RTI Act, 2005 in great danger.

Against Point Number 1 of my RTI Application to CPIO of MHA dated 16.10.2022, MHA is the best authority in this world to give accurate reply, but CPIO of MHA chose not to give any reply at all. FAA of MHA too supported CPIO of MHA’s illegal action. Thus both CPIO and FAA of MHA not only violated RTI Act, 2005 but also put RTI Act, 2005 in great danger.

Against Point Number 2 of my RTI Application to CPIO of MHA dated 16.10.2022 (i.e, date of payment of Rs.71,00,000 Crores (US$1Trillion) to me), MHA can easily collect that information under any law and should supply that information to me. But CPIO of MHA chose not to give any reply at all. FAA of MHA too supported CPIO of MHA’s illegal action. Thus both CPIO and FAA of MHA not only violated RTI Act, 2005 but also put RTI Act, 2005 in great danger.

Against Point Number 3 of my RTI Application to CPIO of MHA dated 16.10.2022, MHA is one of the best authorities in this world to give accurate reply, but CPIO of MHA chose not to give any reply at all. FAA of MHA too supported CPIO of MHA’s illegal action. Thus both CPIO and FAA of MHA not only violated RTI Act, 2005 but also put RTI Act, 2005 in great danger.

Against Point Number 4 of my RTI Application to CPIO of MHA dated 16.10.2022, MHA can easily collect that information from PMO and should supply that information to me,. But CPIO of MHA chose not to give any reply at all. FAA of MHA too supported CPIO of MHA’s illegal action. Thus both CPIO and FAA of MHA not only violated RTI Act, 2005 but also put RTI Act, 2005 in great danger.

Against Point Number 5 of my RTI Application to CPIO of MHA dated 16.10.2022, MHA is one of the best authorities in this world to give accurate reply, but CPIO of MHA chose not to give any reply. FAA of MHA too supported CPIO of MHA’s illegal action. Thus both CPIO and FAA of MHA not only violated RTI Act, 2005 but also put RTI Act, 2005 in great danger.

Relief Sought:

Dear Sir, based on the above details and ordeal I have gone through, kindly instruct the CPIO and the FAA of MHA to provide me accurate and complete (point wise) information as sought by me at the earliest.

Secondly also question the FAA why my appeal has not been examined and heard properly. As per section 20 of RTI Act, 2005, please impose the maximum penalty of Rs.25,000 each on the CPIO and the FAA which shall be deducted from their salary.

As I reside far away from your office (and also right now I don’t have enough money to come to your office), it will be suitable for me to attend virtual hearing (through whatsapp video call/ video conferencing).

Therefore, I humbly request you to please consider my arguments mentioned above and give your judgments accordingly.
