Sub: An Appeal under Right To Information Act,2005
Dear Sir,
This is the First Appeal in regards to my RTI application sent to Hon’ble Supreme Court of India (Copy Enclosed) dated 1.7.2020 in which seeking information of vital public importance, my dues of Rs.5,00,000 Croes (70 billion US dollars) and my freedom from this illegal & barbaric confinement along with a written assurance from President of India. Information I sought are not only crucial to me but also very crucial to entire world. Also related to transparency and accountability of activities of Supreme Court of India. As entire world is watching Supreme Court of India, reputation of Supreme Court is at big stake.
But I have not received any reply from CPIO even though mandatory period of 30 days is over. It is an outright violation of RTI act, 2005.
Grounds for Appeal:
In my RTI application to Hon’ble Supreme Court of India dated 1.7.2020, I asked
what action Supreme Court of India had taken on my 18th petition to Chief
Justice of India? I also asked CPIO to
send a copy of the court order to me.
My
RTI application to Supreme Court of India dated 1.7.2020, has been received by
PIO and even though the mandated period
of 30 days is over, the CPIO has not sent the proper/ complete and accurate
information to me. This is a clear violation of RTI act,2005.
Relief Sought :
a) Please instruct the CPIO to give the complete and accurate information forthwith or collect the information and share it with me.
b) Recommend
to the Central Information Commission that a penalty and disciplinary action
should be taken against the PIO under Section 20 (1) of the RTI Act, 2005, for not maintaining and providing the
records/information as mandated in the law. No reasonable cause can be there
for not replying at all.
The
information requested by me was of
vital public importance and according to Section 2
(j)
(iv) and non-availability and non-maintenance of records/documents or
information is a complete violation of Section 4(1)(a)
of the RTI Act and the person
must be penalized for
his/her
act of dereliction of duty and irregularity in work as
per Sections 18 (1) (b), (e) and (f) of RTI Act, 2005.
I am ready
to come to your office for inspection of records or in person hearing of the
appeal if I am invited with sufficient time- as I reside far away from your
office.
Therefore, I humbly request you to please exercise your Power as First Appellate Authority and instruct the CPIO to give the complete and accurate information immediately. And also reprimand the person concerned for his dereliction of duty. Otherwise, as per Sections 18 (1) and 20 of the RTI Act, I will be forced to approach the honorable CIC for the complaint against the FAA as well.
