Dear Sir,

I sent one more petition to The President of India dated 10.12.2020 (Copy Enclosed). After that I sent a RTI application to the President’s Secretariat dated 03.01.2021 (Copy Enclosed) seeking following information:

 

1.    What action honourable President of India/ Republic of India has taken on my above petition to the President of India dated 10.12.2020?

2.    When shall I get my dues of Rs.5,00,000 Crores (70 billions US dollars) ?

3.    When shall I get three written assurances from the President of India?

4.    When the Prime Minister will deploy a high power task force to set me and my family members (those who are captive along with me- as mentioned in my petition to the President of India dated 10.12.2020 ) free from this illegal, inhuman and barbaric confinement?

 

CPIO of the President’s Secretariat vide letter no.1088/RTI/01/20-21 (Copy Enclosed) informed me that the President’s Secretariat forwarded in original my above petition to The President of India dated 10.12.2020 to Secretary to the Government of India, Ministry of Information and Broadcasting for appropriate action. He also transferred my RTI application to The President’s Secretariat dated 03.01.2021 to CPIO of MIB to give reply to me. Then CPIO of MIB vide letter No.1-11011/71/2021-CPGRAM/EW (Copy Enclosed) informed me that MIB returned in original my above petition to The President of India dated 10.12.2020 to the President’s Secretariat. After that the President’s Secretariat vide letter No.1260/RTI/02/20-21 (Copy Enclosed) informed me that the President’s Secretariat again forwarded in original my above petition to The President of India dated 10.12.2020 to PMO for appropriate action and he also transferred my RTI application to the President’s Secretariat dated 03.01.2021 to CPIO of PMO. CPIO of MIB too vide letter No.1-11011/71/2021-CPGRAM/EW asked me to approach PMO to get above information and he too transferred my RTI application to MIB to CPIO of PMO.

A few days back, I received three replies from CPIO of PMO (copy of all three replies enclosed) on two separate date. In all three of his replies, against Point No.1 of my RTI application to President’s Secretariat dated 03.01.2021, he wrote to me that PMO simply filed my above petition to President of India dated 10.12.2020. He also gave me a Registration Number: PMO/PG/D/2021/0059887. I checked the website (given to me by CPIO of PMO) at my mobile phone, in my laptop and in an internet cafe taking hotspot from jio and vodafone SIM card. But I found nothing in that website against that Registration Number. This clearly shows that CPIO of PMO simply tried to fool me and thus violated RTI Act, 2005.

Against Point No.2 of my RTI application to President’s Secretariat dated 03.01.2021, CPIO could have easily gave me the information (i.e, date of payment of Rs.5,00,000 Crores to me). PMO is the best authority in India to give this information to me. PMO could have collected this information under any law and should have supplied that information to me. CPIO of President’s Secretariat in his reply to me asked me to collect this information from PMO. But CPIO of PMO chose not to give information against this particular point and thus violated RTI Act,2005.

Against Point No.3 of my RTI Application to President’s Secretariat  dated 03.01.2021, CPIO of PMO should have collected the information from MHA and should have supplied that information to me. Or else PMO could have forwarded my above Petition to MHA to issue three written assurances to me on behalf of President of India. But he chose not to give information against this particular point and thus violated RTI Act,2005.

Against Point No.4 of my RTI Application to President’s Secretariat  dated 03.01.2021, PMO is the best authority in India to give information against this particular point.  But CPIO of PMO chose not to give information against this point and thus violated RTI Act,2005. 

From above it is crystal clear that CPIO of PMO not only violated RTI Act, 2005 by above manners but also put RTI Act,2005 in great danger.

Relief Sought:

a)    Please instruct the CPIO to give the complete (point wise) and accurate information forthwith or collect the information and send it to me.

b)    Recommend to the central information commission that a penalty and disciplinary action should be taken against the CPIO under RTI Act,2005 for violation of RTI Act,2005 by above manners.

As I reside far away from your office, it will be suitable for me to attend virtual hearing (through whatsapp/ Telegram video call). Otherwise also I am ready to come to your office for inspection of records or in person hearing if am invited with sufficient time to come to your office- as I reside far away from your office.

Therefore, I humbly request you to please exercise your power as First Appellate Authority and instruct the CPIO to give complete (point wise) and accurate information immediately. Also recommend to the central information commission that a penalty and disciplinary action should be taken against the CPIO under RTI Act,2005 for violation of RTI Act,2005 by above manners. Otherwise I’ll approach honourable CIC to initiate action against you as per RTI Act,2005.
